In the settlement, the companies and their owner agreed to stop selling their YMotion Progesterone cream or any other products as treatments for human illnesses or diseases unless they are first approved by the FDA. In addition, the companies and their owner agreed not to make any health claims in their advertisements unless they possessed clinical research proving their claims to be true. The Right Solution agreed to return all payments it received from consumers who by December 11, 2006 file complaints about the YMotion Yam Cream or any other topically-applied, hormone-containing cream product sold by The Right Solution, and agreed to pay a $100,000 civil penalty.
In addition to the District of Columbia, the states that participated in the settlement are: Arizona, California, Illinois, Kentucky, Maryland, Michigan, Missouri, Montana, Nevada, North Carolina, Ohio, Oregon, Pennsylvania, Tennessee, Vermont, Washington and Wisconsin.
Consumers who wish to file claims for restitution may either write to the Consumer and Trade Protection Section (Attn: The Right Solution Claims), Office of the Attorney General, 441 4th Street, NW, Suite 450N, Washington, DC 20001, or file a claim by completing the online Consumer Complaint Form on the Attorney General's website at http://www.oag.dc.gov. All claims should include information about the products purchased, including dates, prices, and quantities bought, and must be received no later than December 11, 2006.
