DC Tax Office Repeals Its Form 990 Filing Requirement

(Washington, DC) - The Office of Tax and Revenue (OTR) eliminated the IRS Form 990 filing obligation, effective December 12, 2008.  Therefore, DC nonprofit organizations are no longer required to file a copy of their Form 990 with OTR.

The requirement was eliminated to ease the administrative burden on both the agency as well as nonprofit organizations. The information on Form 990 is available to OTR from other sources.

Page five of the 2008 Individual Income tax booklet indicates that “an organization recognized as exempt from DC taxes must, in order to maintain its DC tax-exempt status, send a copy of its IRS Form 990, 990PF or 990EZ.” Please note that the tax booklet was printed before the requirement was repealed.

For further information, please contact OTR’s Customer Service Center, at (202) 727-4TAX.
